Garrett Rolfe Granted Bond in Murder of Rayshard Brooks. Bond Set at $500,000

Today Fulton County Superior Court Judge Jane Barwick granted bond to former officer Garrett Rolfe in the murder of Atlanta father Rayshard Brooks. Judge Barwick set bond at $500,000, with the conditions that Rolfe be placed upon an ankle monitor with a 6am-6pm curfew, Rolfe must surrender both his passport as well as all weapons, Rolfe is not to in anyway tamper with evidence, or have contact with any other Atlanta police officer. Rolfe's file shows 12 other incidents, one in which he discharged his weapon in 2015 which had no conclusion listed in his file. Rolfe faces the death penalty if convicted of the charges he faces.

An Emotional Hearing.

Brooks’ widow Tomika Miller gave a victim impact statement during the hearing. saying her life has been completely turned upside down since her husband was killed … she can’t eat, can’t sleep and can’t console her children. She stated that Rolfe being granted bond. would both effect her mental health and that of her children.

“My husband did not deserve to die and I should not have to live in fear while waiting for the man who killed my husband to be tried in court,” Miller said. “My husband wasn’t perfect, but he didn’t deserve to die.”

For that reason, she’s asking the judge to deny Rolfe’s request for bond, saying … “Mentally, I am not able to handle it.”

Rolfe's bond was set at $500,000 with several conditions in place as well

Half of that amount is a $250k straight bond for the felony murder charge, and the other half is a combination of bonds for all of his other charges.

  • Must wear an ankle monitor
  • Will have a curfew from 6 p.m. to 6 a.m. with exceptions for work, legal or medical
  • Must surrender his passport
  • He will not be allowed to possess or carry any firearms
  • Will not have any contact with family members of Rayshard Brooks or any witnesses, including the three other victims in the case
  • Will not have any contact with other police officers

Fulton County District Attorney Paul Howard announced 11 charges against Garrett Rolfe, including multiple acts of aggravated assault. Howard made particular notice that Rolfe kicked Brooks while he lay dying.

Howard made it clear ... he does not believe Rolfe feared for his life in any way, shape or form. Howard noted Brooks had been cordial, cooperative and calm for more than 41 minutes. The D.A. said Rolfe was not motivated by fear but rather "another type of emotion." Howard didn't specifically say which emotion, but did say you can hear Rolfe right after he shot Brooks say, "I got him."

It's especially significant the other cop, Devin Brosnan, is now cooperating with the D.A.'s investigation.

Howard has charged Brosnan with aggravated assault -- he's on video stepping on Brooks' shoulder. He's also been charged with failure to render timely aid. He could face more than 20 years in prison, but it's almost certain he'll get way less for cooperating.

The charges Rolfe is facing are as follow and could carry the death penalty

  • 1 Count of Felony Murder
  • 5 Counts of Aggravated Assault
  • Aggravated assault with a deadly weapon linked to Brooks' death. The offense carries a possible sentence of 1 to 20 years.
  • Aggravated assault for kicking Brooks. Rolfe was wearing a shoe "which, when used offensively against a person, is likely to or actually does result in serious bodily injury,"
  • Rolfe faces four additional charges linked to the third shot he fired, a bullet that hit an occupied vehicle in the Wendy's lot. Three aggravated assault charges related to the three people who were inside the vehicle.
  • 4 Counts of Violation of Oath of Office
  • 1 Count of Criminal Damage to Property
